判決は，東日本大震災発生前の段階で大川小学校関係者が，学校周辺への津波の可能性を認識しておらず具体的な避難場所等を決めておかなかったことや，地震発生から15時半頃までの間に校庭にとどまったという判断については，注意義務違反ではなかったとした．15時半頃，石巻市の広報車が伝えた北上川河口付近の松林を津波が越えているという情報に接して以降は，大規模な津波が到達することを予見できたとしており，この広報車による情報に重きを置いている． このように，震災前から地震直後と，津波到達直前で分け，予見可能性をやや限定的に判断していることは，現に15時半以降に児童らの避難行動が行われていることも考えると，一定の理解ができる．たとえば「(震災前の時点でも)想定外の事態にも当然備えなければならなかった」「地震発生直後に当然大きな津波は予見できたはずだ」といった，幅広い予見可能性が認められたわけではないことは，率
